FMCSA Revises HOS Rule Consistent with U.S. Court of Appeals Ruling

Yesterday, the Federal Motor Carrier Safety Administration (FMCSA) issued a final rule exempting short haul drivers from the 30 minute rest break provisions. FMCSA had already issued an enforcement policy to this end following the U.S. Court of Appeals’ favorable ruling regarding the applicability of the new rest break requirements to these drivers. Yesterday’s rule simply codifies this policy into regulation. Briefly, drivers who meet either of the two short haul exemptions in the hours of service regulations  (395.1 (e) (1) or (2)) are no longer subject to the 30 minute rest break requirements that went into effect this past July 1.
